The Commercial Manager is responsible for commercially managing assigned Project(s), ensuring each is successfully delivered and commercially protected. Reporting directly to the Commercial Director, with a dotted line of accountability to site management of assigned Project(s), the role develops and implements Project commercial strategies; reviews contract and tender documents; identifies commercial risks and liabilities; drafts commercial qualifications and contract amendments; and ensures commercial processes, budgets and changes are managed consistently and in accordance with company governance.

Key Responsibilities
-
Direct, manage and execute the commercial function on assigned Project(s), providing functional direction to Project-based commercial staff and working closely with the Project Controls Manager and team.

Develop and lead commercial strategy, governance and reporting on assigned Project(s), including client engagement, negotiation of new work, and resolution of commercial issues and disputes.

Lead the change-management process by identifying, valuing, substantiating and progressing variations and change events to timely agreement with the Client, while protecting the Contractor's entitlement through proper records and evidence.

Administer contracts in accordance with their terms and timeframes, including notices, records, correspondence, payment applications and certificates, while maintaining a complete audit trail.

Review contract and tender documents, draft commercial qualifications and contract amendments, and verify and support the execution of contracts.

Identify, manage and mitigate commercial and contractual risk, maintaining a risk register for each Project and reporting risks, liabilities and mitigation actions to site management and Commercial Director.

Work closely with the Project Controls Manager and team to ensure planning, cost, schedule, change and performance monitoring align with each Project's commercial requirements and are applied consistently.

Lead the internal forecasting and review cycle, including cost-to-complete and final-account forecasts, monthly reporting and variance analysis against budget.

Work with EstimatingStudies to maintain a feedback loop between estimates/budgets and actuals, improving cost accuracy and informing future tenders.

Oversee Project cashflow, payment applications and final accounts, ensuring timely billing, full cost recovery and protection of margin.

Lead the preparation, defence and rebuttal of claims on assigned Project(s), and participate in Client negotiations to resolve contractual issues.

Drive continuous improvement in commercial systems, processes and resourcing, including digital solutions for tracking Project performance.

Travel Requirements
-
This position is based on a hybrid arrangement, working Monday to Friday across assigned Project sites, the office and remote locations to ensure each Project receives regular on-site commercial support. Project(s) are currently located in Saskatchewan.

Additional travel to Project sites, the office or Client locations may be required from time to time to meet Project needs.
Supervisory Responsibilities
-
Coordinate the responsibilities and functions of commercial staff supporting assigned Project teams, ensuring work is completed in accordance with company policies and established procedures, including when the Commercial Manager is off site.

Ensure the orientation and integration of dotted-line reports, including change-management staff within each Project's Controls team.

Develop personnel capability to meet company needs and objectives and support staff performance evaluations.

Support recruitment and selection of commercial personnel for assigned Project(s).

Provide functional commercial direction to Project based commercial staff; partner with the Project Controls Manager on cost, change and reporting; and work with the relevant site management on day-to-day priorities within the matrix structure.
Education and Experience
-
Degree in Quantity Surveying, Commercial Management, Construction/Engineering Management, Law, contract law or a related commercial discipline.

Relevant experience as a commercial manager, senior quantity surveyor, contracts specialist/administrator or senior procurement professional, ideally on construction, mining or major infrastructure Projects
-
Minimum of 10 years' relevant experience.

Experience administering bespoke or negotiated construction contracts, including amended standard forms, and managing change, claims and Project controls.
Skills, Knowledge and Abilities

Strong leadership and conflict-management skills.
-
Exceptional written and oral communication skills in English.

Expert report writing is considered an advantage.

Able to work under pressure and manage competing priorities across multiple Projects.

Strong analytical skills, including the ability to review contracts and other commercial documents.

Strong commercial and financial acumen - understanding of margin, cost drivers, cash flow and contractual entitlement.

Able to build and maintain lasting relationships with departments, business partners and stakeholders.

Able to work effectively both independently and as part of a team.
-
High level of confidentiality and trust. Strong working knowledge of Project cost management, Project controls, scheduling, bespoke and amended standard-form construction contracts, and related change and claims processes.

Able to work autonomously and maintain commercial oversight across multiple Projects, while rotating between Project sites, the office and remote work.
